The Strategic Value of Electronic Discovery


A recent survey of South African litigation practitioners revealed that less than 25% of documents produced during discovery or at trial are produced in electronic form, despite the fact that more than 90% of litigious documents having been created electronically. This free white paper highlights the impact of the Electronic Communications and Transactions Act on the Uniform Rules of Court and reveals why, in many cases, current practice falls short of best practice.

Electronic Communications and Transactions Act No. 25 of 2002


This act provides for the facilitation of electronic communications in South Africa and, amongst other things, repealed the Computer Evidence Act and introduced new legislation governing the legal recognition of data messages, electronic signatures, the admissibility and evidential weight of data messages and rules relating to the production or retention of information.
